Important: Please read this agreement carefully before using our services. Your continued use of eWebGuru services constitutes acceptance of all terms and conditions listed in this document.
The following policies govern how you may use eWebGuru's hosting infrastructure and shared resources. Violations of these terms are grounds for service termination.
Excessive CPU, Bandwidth or Disk Space usage has the ability to compromise our shared hosting environment. Using the system in a manner that encumbers disk space, processors or other system resources beyond the allowances of your specific plan type — and to the degree that it compromises the hosting accounts of other customers — is strictly prohibited.
CGI scripts or other executable code that consumes an undue amount of CPU time will be reprioritized, or you will be asked to discontinue or alter its use. Failure to cease operation of an offending executable will be considered server abuse. eWebGuru reserves the right to terminate any process it deems to be using excessive resources.
Background processes — applications or utilities started from an interactive shell login and set to run permanently in the background — are not permitted without prior written arrangement and confirmation from eWebGuru. Running background processes without prior written authorization is considered server abuse.
eWebGuru prohibits the storage and transmission (inbound and outbound) of pornography, with the exception of softcore erotic art. Written permission must be obtained before any pornographic material is stored and/or transmitted through eWebGuru servers. Adult sites are not allowed on our servers (see 1.15).
Copyright software, Warez, destructive applications, copyright media, proprietary computer information and hacking & cracking sites are strictly prohibited on any portion of our services and network. Customers storing & transmitting files that violate copyright or other laws are subject to immediate termination of service.
Any incident of server abuse is grounds for immediate and unconditional account termination. eWebGuru reserves the right of interpretation as to what constitutes abusive practices. If you are unsure whether your actions may be perceived as an abuse of service, contact eWebGuru directly before proceeding.
Unsolicited Commercial Email (Spam) is implicitly forbidden. This is considered server abuse and is grounds for immediate termination without notice.
eWebGuru prohibits any portion of its services to be resold without charge. This includes but is not limited to: entire hosting accounts, email services, scripts, FTP accounts, MySQL databases, applications, licenses, webspace and bandwidth (including image hosting and file/data hosting services).
Proxy websites and similar services are strictly prohibited on eWebGuru servers.
The allocated space is for website use only. It cannot be used for storing files or software not linked to your website. eWebGuru will not tolerate misuse of the allocated space.
Hosting of MP3 files and video files is not permitted on our servers.
File hosting sites or sites designed primarily for downloadable content are not allowed in our webspace.
Bandwidth allocated is only for the website hosted on our server. Using bandwidth for other websites via hotlinking is not allowed.
Webmail can be used only for temporary storage of emails. We recommend using POP3 to download emails to your own PC. Storing emails permanently in webmail is not permitted.
Hosting of adult sites is not permitted on our servers under any circumstances.
All accounts are managed on a pre-pay basis. The following terms govern billing, suspension, and refund eligibility for eWebGuru services.
All accounts are set up on a pre-pay basis only. Payments must be made in advance to activate or renew any hosting service.
eWebGuru will suspend your account if outstanding bills have not been paid within 5 days. eWebGuru reserves the right to suspend the account and to charge a late fee if bills are not paid in time.
eWebGuru reserves the right to impose a reactivation fee for accounts that have been suspended due to non-payment or policy violations.
If the services provided are not as described on our website or are not functioning properly, you may request a refund within the first 7 days of your hosting account activation. Refunds will be issued within 24 hours of the refund request. Domain Registration, SSL, Dedicated Server and VPS services are non-refundable.
Refunds will NOT be granted in the following cases:
While eWebGuru performs regular server backups, customers are strongly encouraged to maintain their own backups. Please review our backup policy carefully.
We strongly encourage all customers to maintain their own backups on their home computers or external storage to ensure ready access to data in the event of hardware failure.
Although we regularly take backups of our servers, we cannot guarantee their availability, completeness, currency, or integrity. Consequently, you must not rely solely upon eWebGuru backups.
Customers are solely responsible for maintaining their own backups on personal or other computers and storage media.
eWebGuru does not provide any compensation for lost, inaccurate, incomplete, or outdated data in the event that backups do not function properly, regardless of the reason — even if the malfunction was due to the fault or negligence of eWebGuru.
To ensure fair service for all customers on shared hosting, the following resource usage restrictions apply. Violation of these policies may result in service suspension.
Users May Not:
Use 20% or more of system resources for longer than 90 seconds (includes CGI scripts, FTP, PHP, HTTP, etc.)
Run stand-alone, unattended server-side processes at any time, including any and all daemons such as IRCD
Run any type of web spider on shared servers
Run any software that interfaces with an IRC (Internet Relay Chat) network
Run any BitTorrent application, tracker, or client (linking to off-server torrents is permitted)
Participate in any file-sharing or peer-to-peer activities
Run gaming servers such as Counter-Strike, Half-Life, Battlefield 1942, etc.
Run cron entries with intervals of less than 15 minutes
Daily Average System Resource Limits (CPU, RAM, MySQL):
If you subscribe to a product with no usage caps, this Fair Usage Policy (FUP) applies to your account and all associated services.
A Fair Usage Policy is necessary to ensure our hosting services are used fairly and operate reliably for all customers. This policy governs all hosting services including Reseller Accounts, Web Hosting, VPS and Dedicated Servers.
What constitutes "excessive" use is determined by multiple factors including the duration and amount of resources consumed. We aim to be fair to all customers rather than impose a rigid fixed figure.
If we determine in our reasonable opinion that you have breached this FUP, we will contact you by email to advise that your usage is excessive and affecting eWebGuru services and/or other users.
Resources such as MySQL databases, subdomains, POP3/SMTP mail accounts, and FTP accounts should not be created or used in a way that adversely affects the normal operation of our services.
eWebGuru reserves the right to terminate the hosting contract and refuse to renew service if client usage of resources is found to be violating this Fair Usage Policy.
